01/06/2010

The Mohawk Council of Kahnaw:ke would like to inform the community that the next Justice Hearing will be held Wednesday, 3, Ennska / February, 2010 at the Kahnaw:ke Moose Lodge from 1 pm to 4 pm.

At the last hearing, the 2 questions posed to the community were:

1. Should judgments, orders and decisions from a (Kahnaw:ke) justice system be recognized outside the Territory?

Community Response: Yes, we want our judgments, orders and decisions to be recognized by every jurisdictional authority.

2. Given the communitys answers to the previous 3 questions, does the Justice Commission have a mandate to develop a justice system, and do you have any further concerns or qualifications?

Community Response: Yes, we agree to have the Justice Commission move forward, with the following qualifications :

a. Justice Commission/Interim Legislative Coordinating Committee must seek more participation from the community;
b. Justice Commission will develop a draft document on the development of a justice system to bring back to community;
c. Community must have at least 30 days to review and provide feedback on this draft;
d. Determine if a community member need to be present in order to be a Community Representative; and
e. Formalization of all above will occur in January.

Although there was unofficial agreement, the community decided that the mandate and qualifications would be formalized and the three (3) community representatives would be chosen at the next hearing.
